22. Criminal Damage Act 1971 s.1 (2) provides that a person
is guilty of an offence if without lawful excuse, they destroy
or damage property, belonging to them self or another, with
intent or being reckless as to destroying or damaging property and with intent or being reckless as to endangering life.
Mr David Smith is a Colorectal and General Surgeon at the Royal Bolton
Hospital and at BMI |e Beaumont Hospital. He undertook a BSc (Hons)
in Biochemistry at the University of Liverpool before undertaking his
primary medical degree. He trained on the Manchester surgical rotation
and specialised in colorectal surgery.

He has also developed a practice in the management of rectal polyp
surgery through the newly developed TAMIS (trans-anal minimally
invasive surgery) technique. His other areas of interest and practice include
laparoscopy, management of anorectal disorders (haemorrhoids, ossure and
ostula) and endoscopy (gastroscopy, nexible sigmoidoscopy and colonoscopy).

of another person by driving a mechanically propelled vehicle on a road or other public place without due care and
attention, or without reasonable consideration for other persons using the road or place, is guilty of an offence.”
In addition, he is an active member of the multidisciplinary team for the
management of colorectal cancer and innammatory bowel disease. He is
actively involved in surgical training, clinical audit and research.

Mr Atul Khanna is a Consultant Plastic, Reconstructive and Hand Surgeon and has been involved in medical legal
work since 1998.
In this period he has provided over 3,400 medical reports. These have been predominantly in the
following areas of expertise:
• Hand surgery: Sequelae of hand injuries and surgery
• Soft tissue injury: Sequelae of post traumatic scarring
• Burns management: Sequelae of disability following burns injury, scarring and surgery.
• Medical negligence in Cosmetic Surgery
His work involves the treatment of patients with hand injuries, burns, soft tissue and facial injuries, breast surgery, scars
and deformities, skin cancer and cosmetic surgery.
He is on the GMC’s specialist register in Plastic Surgery and is a member of the society of expert witnesses.
