As the outcome in various cases set out above demonstrate, the answer to this question often depends upon
the Court’s view on the overall merits of the case,
rather than a genuine analysis of whether the spillage
could have been cleaned away prior to the accident,
which raises the question of whether Ward really adds
anything at all.

In the final analysis, it is clear that Ward v Tesco Stores
remains good law in this jurisdiction, and will continue
to assist Claimants in various factual situations where
