tabled on 11 May 1853, entitled "Petition of Grievances; —New
Constitution".
Also included with M11190 are Secretary of State Despatches Nos.
12 and 13 of 25 and 18 January 1853 respectively.
Secretary of State Despatch No. 12 of 25 January 1853 is
topnumbered M11192. In this Despatch Newcastle acknowledges
receipt of the Governor's despatch, No. 130 of 20 August 1852, in
which was enclosed the Legislative Council's reply to Earl Grey's
despatch of 23 January 1852. "But as the questions raised in these
documents have been for the most part disposed of for the present
by Sir John Pakington's Despatch of 15th December last, No.95,
and the remainder must for the present await the further
communications which I expect on the subject of Constitutional
reform, I do not think it advisable now to enter into any further
discussion of the subject".
Secretary of State Despatch No. 13 of 18 January 1853 is
topnumbered M11191. In this Despatch the Duke of Newcastle
acknowledges receipt of the Governor's despatch, No. 144 of
31 August 1852, in which the Governor reported on the Votes of
the Legislative Council on two important questions. The Duke of
Newcastle expresses concurrence with the views of Her Majesty's
late Government on the future administration of the affairs of the
Colony.
You inform me that a Committee of the Council is engaged in
the preparation of a Scheme for the Amendment of its
Constitution. As such a measure is impending, it is only
necessary for me now to inform you that as soon as it has
passed the Legislature of the Province and received the
Approval of Her Majesty the disposition of the Waste Lands, and
the appropriation of the Fund arising out of their sale and
management will be placed without reserve under the
supervision and controul of the Legislative Authority in the
Colony.

Included in [4/1336] is Despatch No.7 of 23 January 1852: the
Secretary of State acknowledging receipt of the Governor's
despatch of 18 June 1851 (No.105), in which was enclosed an
Address from the late Legislative Council embodying a Declaration
and Remonstration against the Constitutional Act 13 & 14 Vic c.59.
Stating his regrets as well as doubts about whether the
Remonstrance accurately expresses the feeling of the community
("Her Majesty's Government in framing this measure, took as
much pains as was in their power to make themselves acquainted
with, and to consult, the feelings as well as the wants of the
Colonists, and had every reason to believe that they had
succeeded in doing so"), Earl Grey replies at length to the
"charges" made against the Act by the Council.
