1851 Minutes — M9770
M9770 is a printed copy of the Secretary of State Despatch of
30 August 1850 (No.125). In this Despatch Earl Grey transmitted
a copy of the Australian Colonies Government Act, 13 & 14 Vic
c.59, it having at length received the Royal assent as well as
commenting on the rationale behind the Act and some of its
features, including the power of the New South Wales Legislature
to amend the Constitution. Also included is a second copy of the
Despatch with two of its enclosures, ordered to be printed by the
Council on 28 March 1851.

Minute books — Minutes relating to the electoral and
legislative arrangements following the Australian Colonies
Government Act of 1850, 1851
The 3rd section of 13 & 14 Vic c.59, the Australian Colonies
Government Act, empowered the Governor and the Legislative
Council to determine the number of members of the Council after
the separation of the District of Port Phillip and the Electoral
Districts into which the Colony should be divided.

At the meeting of the Executive Council of 21 January 1851 the
Governor laid a copy of this Act upon the table and asked the
Council for its advice on these points prior to submitting proposals
to the Legislative Council in the Bill to be introduced in the next
Session. The Governor also laid a copy of a new map of the Colony
compiled by the Surveyor General, and a number of statistical
returns showing the population and property in the different
Districts of the Colony, "for the representation of which provision
was to be made".
At its meeting on 4 February the Executive Council advised that in
the Bill to be submitted to the existing Legislative Council "it shall
be proposed that the Legislative Council of New South Wales, after
the separation of the Port Phillip District, shall consist of 48
Members, of whom, according to the proportion fixed by the
Second Section of the same Act, 16 will be appointed by Her
Majesty, & 32 will be elected by the Inhabitants of the Colony".
The Council then detailed the 29 Electoral Districts from which
these 32 members would be elected and would represent.

Secretary of State. This transmits a copy of an Act of Parliament
entitled An Act for the Government of New South Wales and Van
Diemen's Land, 5 & 6 Vic c.76, assented to on 30 July 1842.
