Also included are extracts from Executive Council minutes of
meetings whereby the Council advised that a declaration should be
made and notified by Proclamation in the Government Gazette
within the time prescribed by the Act. The circumstances
associated with this were cases where writs for a particular
Electoral District had not been returned by the appointed day,
hence the election would be invalid unless its validity were
declared by the Governor with the advice of the Executive Council
under the provisions of the 56th clause of the Act of Council 6 Vic
No.16.
Among these papers is a June 1843 protest against the return of
Henry Condell as Member for the Borough of Melbourne by Edward
Curr, the unsuccessful candidate.
Although mentioned in the correspondence, the writs of election
and voting papers are not here.
1843 Election - Papers
This bundle includes a copy of Act 6 Vic No.16, An Act to provide
for the division of the Colony of New South into Electoral Districts,
and for the Election of members to serve in the Legislative Council
(23 February 1843).

It mainly comprises papers associated with the setting up of the
first elections for members of the Legislative Council. Included
are: declarations accepting the office of Collector to make out the
Elector List (otherwise the Collector for the Registration of Voters)
and of persons assisting the Collectors; declarations of Returning
Officers, Deputy Returning Officers, Assessors to assist in the
Revision of the Electoral List of Voters, Clerks to the Bench, Police
Magistrates, Presiding Magistrates and Revising Officers;
declarations of John Hosking as Mayor of the City of Sydney and of
Charles Henry Chambers as Town Clerk; declarations of the Mayor
and Aldermen of the City of Sydney as Aldermen, and of the
Aldermen as Deputy Returning Officers; notifying the most
convenient' polling places; accepting appointments as Returning
Officers and Polling Clerks; acknowledging receipt of Commissions
as Assessors; papers re informality of a declaration; and
declarations of Poll Clerks for the City Election taken before them
(CSIL 43/4514).
1843 Election - Expenses
This bundle comprises claims for compensation: payment of
allowances to collectors of voters' names; requests for authority to
appoint persons to assist in collecting electors' names; claims for
erecting polling places; submitting accounts of collectors of
electors' names; Returning Officers submitting accounts of
expenses for election; applications for expenses of Polling Clerks;
reports on claims and accounts of expenses; for remuneration for
business done in connection with the election of members for the
Legislative Council by the Town Clerk, Sydney; for settlement of
election expenses; re remuneration for Collectors and Polling
Clerks; accounts for printing during election; and, claims for
printing electoral lists and for advertising.
