1848 Miscellaneous — CSIL 48/2482
CSIL 48/2482 comprises papers dating 1847-48 relating to the
election of a new member to the Legislative Council in lieu of Dr
Lang, one of the members for the District of Port Phillip, who was
deemed to have vacated his seat because of non-attendance of the
Council for two sessions, without permission. Included is
correspondence from the Speaker of the Council, the Civil Crown
Solicitor and the Superintendent of Port Phillip.

The Speaker of the Legislative Council reported to the Colonial
Secretary on 30 October 1847 that Reverend John Dunmore Lang
had failed to attend the Legislative Council for the last two
sessions, which was in contravention of the 16th clause of Imperial
Act 5 & 6 Vic c.76. The Civil Crown Solicitor was asked for his
opinion on the matter, which was that his seat was vacant
(permission not having been obtained from Her Majesty or the
Governor for his nonattendance) and that the Governor should
issue a new writ for the election of a member to serve in his stead.
A new writ was issued on 23 November 1847. At the public
meeting for nominations on 15 December 1847, John Moore Cole
Airey was the sole nominee and was therefore declared duly
elected by the Returning Officer.

Returns of electors, 1844-51

Box [4/1145] comprises papers relating to returns of electors
which appear to have been submitted to the Legislative Council
annually.
The earliest paper is LC 19, an Address from the Legislative
Council, dated 26 July 1844, requesting a return of the number of
electors in each Electoral District, distinguishing the number in
each electoral list prepared since the passing of the Act of Council
6 Vic No.16 of 1843.
The majority of the papers are letters from Returning Officers
reporting the number of voters in their respective Electoral
Districts, Addresses from the Council requesting the returns of
electors and the resultant returns, which are either in manuscript
or printed form. The printed return for 1850 shows the number of
electors in each Electoral District for the years 1843-44, 1844-45,
1845-46, 1846-47, 1847-48, 1848-49, 1849-50 and 1850-51. The
final return is for the number of electors on the electoral roll of
each Electoral District in New South Wales under the Act of Council
14 Vic No.48, ordered to be printed 17 December 1851.
Also included is some correspondence concerning electoral lists
(transmission of, payment of postage on, etc).
Legislative Council election, County of Durham, 1849
This bundle commences with a letter from William A Purefoy,
President of the Electoral Court (the court for disputed elections),
certifying that in the opinion of the Court "Stuart Alexander
Donaldson was not duly elected and that there was no legal
Election, by reason of the neglect of duty on the part of the
Returning Officer, in not appointing Deputy Returning Officers, to
