DIVISION 8 - SICK LEAVE
Division 8 empowers the Commission to insert sick leave
•provisions in awards.
DIVISION 9 - EQUAL PAY
Division 9 empowers the Commission to insert equal pay
provisions in awards.
DIVISION 10 - AUSTRALIAN TRAINEESHIP SYSTEM
Division 10 empowers the Commission, on application being made
to it, to make an award containing, or to insert in an
existing award, Australian Traineeship System provisions.
PART 3 - AWARDS AND AGREEMENTS GENERALLY
DIVISION 1 - AWARDS
Division 1 deals generally with the purpose, effect, content,
term, variation, rescission and other like matters relating to
awards. In negotiating an award, parties are required to act
in good faith and the Commission may have regard to their
conduct in exercising its functions under the Division. An
award applies generally for a period of 12 months to 3 years,
being its nominal term. During its nominal term an award may
be varied with the consent of the parties to the making of the
award, or, without that consent, in limited circumstances
only.
DIVISION 2 - ENTERPRISE AGREEMENTS
The Division deals generally with the purpose, effect,
content, term, variation, rescission and other like matters
relating to enterprise agreements.
The purpose of an enterprise agreement is to regulate (wholly
or partly) the employment conditions of persons employed in a
single enterprise in one or more trades or occupations. A
registered enterprise agreement is enforceable as if it were
an award and its provisions prevail over the provisions of any
award, former industrial agreement or Commission order which

parties to an enterprise agreement are an enterprise employer
and (a) one or more industrial organisations of employees
representing actual or potential employees in the enterprise,
(b) each of not less than 65% of individuals employed in one
or more trades or occupations in the enterprise, or (c) a
works committee representing persons employed in the
enterprise.
