A simplified maximum working hours provision has been
developed to replace existing provisions. The maximum
standard working week will now be 40 hours, averaged over a 52
week period.
Provision has been included to allow legal proceedings to be
brought, and orders made, for payment of contributions due to a
superannuation fund. This is necessary because of the low level
of observance of occupational superannuation provisions.
The Court will be given the function of certifying new matters.
It had originally been intended that this would rest with the
Commission but it is more a judicial function.
This issue is concerned with the sanctity of awards. During the
nominal term of an award its provisions are fixed and can only
be altered with the consent of all parties except in limited
circumstances. One of these circumstances is where a matter has
been certified as a new matter.
Paternity leave and adoption leave provisions are included as
previously approved (although it should be noted that employer
groups have voiced their opposition to such provisions).
Right of entry to workplaces by officers of industrial
organisations without notice in order to talk to members will
not be permitted for workplaces where no members of the
organisation are employed.
