walked
up and placed his hand on a man at right of the line

man was not Freeman. lie then went and sat down, he
returned
almost immediately, and said to the man on the right
of the

line "I am sorry, I/made a mistake, you are not the man,
this
is the man here", at the same time placing hishand on
accused
FreewaL,r, shoulder.
Freeman did not speak.
After all the
other men who had formed the line were removed from
the yard,
I said to Eden in the presence of the accused Freeman "I
want to take down in writing when and where you saw the
accused". Eden said "Between 12 and 1 o'clock on the 10th

about the same size as the accused, the police took
pusses.—
ion of the grey car and drove it away". I said
to accused
Freeman "You have heard what this man has said". He

his head in the affirmative, out made no reply.
I afterwards
charged him with the present charge. He replied "All
