PARISH COUNCIL VACANCIES
U
nder the Coronavirus Act 2020 no elections or referenda can take place until
6th May 2021. The normal four-year term for parish councillors was due to
end on Polling Day on 7th May 2020 but this was extended by the government
for an additional year to 6th May 2021. A number of Brenchley and Matfield
Parish Councillors were unable to continue for a further year and submitted their
resignations. However, five Councillors have agreed to continue to work on behalf
of the community and the Council had hoped to co-opt new councillors from the
wider community during the next few months.
Under the Local Government Act 1972 a casual vacancy must first be
advertised by TWBC and Rule 5(2) of The Local Elections (Parishes and
Communities) (England and Wales) Rules, 2006 allows for ten local government
electors for the Brenchley and Matfield Parish to request the Returning Officer to
hold an election to fill the vacancy. If less than ten requests are received, a Parish
Council is allowed to advertise the vacancy within the community and co-opt a
councillor from applicants through its Co-option Procedure.
Notices were posted on 10th June 2020 to publicise each of the four vacancies
and responses were accepted up to 30th June 2020. It appears that ten or
more electors have requested an election for each of the four vacancies but,
under the Coronavirus Act, no election can take place before 6th May 2021. As
a consequence the Parish Council will be unable to either elect or co-opt new
councillors at this time.
Under its Standing Orders the Parish Council may appoint persons, other than
Council members, as non-voting members to any committee, except the Finance
Committee. The Parish Council is considering whether to invite members of the
community, if they feel they have the time, to contribute to the work of the Parish
Council during the next nine months. This would provide insight into the role of a
Parish Councillor and perhaps encourage prospective candidates for the election in
2021.
