A real deal baker?
In December 2020 Google and Amazon were fined €100 million and €35 million respectively by the French data protection authority, the
CNIL. Both organisations were fined for placing cookies on user devices without obtaining prior consent, and for providing inadequate
information about the cookies on their websites.
Both had automatically placed advertising cookies on the devices of users who visited their websites. Google’s site displayed a banner:
“Privacy reminder from Google” and the site had two buttons “Remind me later” and “Access now”. Amazon’s site displayed a banner: “By
using this website, you accept our use of cookies allowing to offer and improve our services. Read more”.
These staggeringly large fines are a reminder that, both in the UK and in the EU, there are rules about the use of cookies – and regulators
are increasingly turning their focus towards organisations which flout them. Not only this, but consumers are increasingly becoming aware
of them as well.
These fines, combined with the fact that new rules about the use of cookies will be introduced in the EU and perhaps in the UK too in due
course, serve as reminders of the importance of complying with ‘cookie law’.
