TERMS & CONDITIONS OF SALE
1. Retention of Title:
a: The goods shall be at the customer’s
risk as from delivery
b: In spite of delivery being made
property in the goods shall not pass
from Pintail Candles until
b(i): The customer shall have paid
the Price plus VAT in full; and
b(ii): No other sums whatever
shall be due from the
customer to Pintail Candles.
c: Until property in the Goods passes to
the Customer in accordance with
clause (b) the Customer shall hold the
goods and each of them on a fiduciary
basis as bailee for Pintail Candles. The
Customer shall store the goods (at no
cost to Pintail Candles) separately from
all other goods in its possession and
marked in such a way that they are
clearly identified as Pintail Candles
property.
d: Until such a time as the property in
the goods passes from Pintail Candles
the customer shall upon request deliver
up such goods as have not ceased to
be in existence or resold to Pintail
Candles. If the customer fails to do
so Pintail Candles may enter upon
any premises owned, or controlled by
the customer where the goods are
situated and repossess the goods.
e: The customer shall insure and keep
insured the goods to the full price
against “all risks” to the reasonable
satisfaction of Pintail Candles until
the date that property in the goods
passes from Pintail Candles, and
shall whenever requested by Pintail
Candles produce a copy of the policy
of insurance. Without prejudice to the
other rights of Pintail Candles, if the
Customer fails to do so all sums
whatever owing by the customer to
Pintail Candles shall forthwith become
due and payable.
2. Unless otherwise agreed in writing the
customer shall make full payment for the
goods within 30 days of the invoice date.
3. If payment is not made by the due date,
Pintail Candles may, without prejudice to its
other rights charge interest at a monthly rate
of 2.5% on any outstanding balances until
payment is made in full.
4. Any costs incurred in recovering the
overdue accounts will be charged at cost.
5. All goods are to be inspected by the
customer on receipt and claims for shortages
/damages must be made in writing within five
working days.
6. Pintail Candles shall have no liability to
the customer in respect of shortage/damage
unless the customer gives the said notice.
7. Pintail Candles, reserve the right to modify
specifications, designs, materials, and finishes of
goods at any time without prior notice.
8. Privacy:
Pintail Candles is committed to looking after
the personal information shared with us. For
business customers and traders, not all the
information we hold is personal information.
Information relating to a customer’s business
will still be covered by these terms and
conditions of sale. For further details on how
we keep personal data secure can be found on
our website.
9. Carriage Costs:
UK Mainland: Carriage is free on orders
over £200 nett. For orders under this
amount carriage is £12 and orders to be
paid proforma. Scottish Highlands/Islands and
Northern Ireland: Carriage is free on orders
over £300 nett. For orders under this amount
carriage is charged at cost (minimum of £20).
Eire: Carriage is free on orders over £400
nett. For orders under this amount carriage
is charged at cost (minimum of £25). Channel
Islands/Isle of Man and other international:
Carriage is charged at cost.
10. First Orders:
UK Mainland: Minimum order is £200 nett
to be paid pro-forma and carriage is free. All
other areas: Minimum order is £200 nett to be
paid pro-forma and carriage costs apply as per
clause 9 above. After three pro-forma orders
have been placed, an account can be set up
subject to satisfactory credit checks.
11. Small Orders:
Orders under £200 nett must be paid by
proforma and carriage costs apply as per
clause 9 above. These conditions do not apply
to back orders and special offers.
