Inventory of Legal Knowledge™
Jeffrey E. Musick, PhD, ABPP, and Randy K. Otto, PhD, ABPP
Evaluate a defendant’s approach to
inquiries about legal knowledge
You are charged with determining the
competency of criminals. Your examinations—and your decisions—will impact
your clients’ futures. During interviews
or when completing assessments,
examinees demonstrate different
response styles. Knowing if a respondent
is likely to feign symptoms during evaluation can help inform your decisions.
Purpose
Age
The ILK uses two strategies to measure
feigning: the below chance approach and
the floor effect approach.
The ILK does not assess your clients’
competency to stand trial—but it does
provide you with powerful information to
help you make important decisions. The ILK
can be used anywhere—including jails and
other secure facilities—and scored quickly.

The MacCAT-CA was developed using
research funded by the National Institutes
of Mental Health. It provides forensic
psychologists and examiners with a
standardized instrument to measure
competence prior to trial. Considered a
tool and not a test, the 22-item structured
interview objectively measures three
competence-related abilities: understanding, reasoning, and appreciation.

Measure your clients’
competency to stand trial
In the United States, criminals are afforded
the right to a fair trial. This means they
must have the ability to understand the
legal proceedings related to their case and
participate in pleas and waivers of their
rights. Ensuring this capacity for meaningful participation helps ensure fair proceedings and accurate adjudication and the
integrity of the adjudicatory process.
