Possible Deficiency:
Cracks in concrete sidewalks.
Performance Standard:
Small cracks that do not affect structural stability are not unusual in concrete sidewalks.
Responsibility:
Builder will repair concrete sidewalks with cracks exceeding ¼" in width or ¼" in vertical
displacement.
Possible Deficiency:
Basement water dampness and leaks in basement foundation wall.
Performance Standard:
Basement walls should not leak. However, dampness of newly constructed concrete walls and floors is
common and not considered a deficiency.
Responsibility:
Builder will repair all wall cracks, regardless of their thickness, that allow water leakage (actual flow
and accumulation) into the basement. Leaks caused by improper landscaping or failure to maintain
proper grade are not covered. Builder is not responsible to make repairs to items damaged by water
intrusion caused by basement foundation wall dampness and leaks.
Possible Deficiency:
Water infiltration onto basement floor not caused by wall cracks and/or improper landscaping and/or
grading by Builder.
Performance Standard:
Basements in this area are subject to water infiltration (other than through the walls) via rising water
tables in extreme weather conditions. Each home is constructed with a basement slab with a
minimum of 4= of stone under basement slab, a perimeter drain in stone bedding around entire
perimeter of foundation, plus a sump pit and sump pump. Most basements rely on the sump pump to
be fully operational in order to avoid water infiltration into the basement at all times. During a power
outage your sump pump will not operate. Consideration should be given by the Homeowner to either
purchase a battery back-up sump pump, a water primed back-up sump pump or backup generator to
ensure your sump pump is operational at all times, especially if finishing the basement. Homeowner
should not store anything of value directly on the basement floor unless/until the final grading and
lawn have been established, and Homeowner has a system in place to ensure the sump pump will
operate in the event of a power outage.
Responsibility:
Joint. Homeowner is responsible to ensure that sump pump is fully operational at all times, even
during a power outage. Builder is responsible to ensure that there is no water infiltration onto
basement floor during normal weather conditions, provided that the sump pump is fully operational
at all times. Builder is not responsible for any damage to items damaged by water in basement.
