MAJOR STRUCTURAL DEFECTS COVERAGE
1ST YEAR THROUGH 10TH YEAR
NOTE:
In the event of a "Major Structural Defect" occurring in the 1st year of coverage,
repairs will also include correction of items necessary to bring the home into compliance
with the Warranty.
The unsafe, unsanitary or otherwise unlivable criteria under "Major Structural Defects" is limited
only to the repair of plumbing, waste, gas, oil & electric lines, ductwork, other mechanical systems
and other items that affect the health and safety of the occupants of the home that were damaged by
the major structural defect.
Exclusions:
In addition to the non-load bearing elements excepted from the definition of Major Structural
Defects, the following damages, losses, deficiencies or defects are not covered by this Warranty.
A. Damages or losses not caused or created by the Builder or their employees, agents or
subcontractors, but resulting from accidents, riots, civil commotion, acts of God or nature,
including but not limited to, fire, explosion, smoke, water escape, changes in the underground
water table (underground springs, etc.), wind storms, hail, lightning, fallen trees, aircraft,
vehicles, floods, earthquakes, mudslides, wind driven water, volcanic eruptions, or soil movement.
B. Any deficiencies in or damage caused by material or work supplied by anyone other than the
Builder or his employees, agents, or subcontractors.
C. Loss or damage resulting from the Homeowner9s failure to minimize such loss or damage or to
notify Builder as provided herein.
D. Normal deterioration or normal wear and tear.
E. Losses or damages to or resulting from defects in improvements which were not completed by
Builder, defects in outbuildings, such as detached garages and carports, swimming pools, detached
recreational buildings and facilities, defects in driveways, walkways, streets, street creep, patios,
decks, boundary and retaining walls, bulkheads, fences and landscaping of all types, including
damage to trees, etc. during the course of construction, French drains, sinkholes and dry rot.
F. Any loss or defect which arises when the home is used for nonresidential purposes.
G. Losses resulting from damages to real property other than to the home itself.
H. Damage caused by insects, squirrels or other animals or rodents.
I. Loss or damage resulting from, or aggravated by changes to the real property, by anyone.
J. Any claim reported to Builder after an unreasonable delay.
K. Loss or damage resulting from, or aggravated by, or occurring to modifications or additions to the
home or lot made after occupancy (other than those performed to meet the obligations of this
Agreement).
L. Personal property damage or bodily injury or punitive damages and/or legal fees.
M. Loss or damage resulting from, or aggravated by, dampness or condensation caused by negligence
of the Homeowner not maintaining proper ventilation.
N. All consequential damages, including but not limited to costs of shelter, transportation, food,
moving, storage or other incidental expenses related to relocation during repair. Excluded
consequential damage also include damage resulting from non-covered or expired items, such as
wood rot from water infiltration after year one.
O. Any defect which does not result in actual physical damage to the home.
