MAJOR STRUCTURAL DEFECTS COVERAGE
1ST YEAR THROUGH 10TH YEAR
P. Any defect, damage or loss which is caused or aggravated by failure of anyone other than the
Builder, his agents, employees or subcontractors to comply with the manufacturers9 warranty
requirements concerning appliances, fixtures or equipment.
Q. Loss or damage resulting from toxic or carcinogenic or suspected carcinogenic fumes or
substances, such as, but not limited to, radon, radon gas, radon daughters, or mold.
R. Water infiltration into a basement or crawl space after year one.
S. Loss or damage resulting from, or aggravated by, negligent maintenance or operation.
T. Any loss or damage resulting from the weight and/or performance of any type of waterbed or other
furniture excessive in weight or other abnormal loading of floors.
U. Any loss or damage resulting from a loss in the water supply, or potability or clarity of water
supply.
V. Solar panel systems or their installation or operation.
W. Soil erosions and run-off caused by failure of the Homeowner to maintain the property established
grades, drainage structures and swales, stabilized soil, sodded, seeded and landscaped area.
All warranty terms and provisions are set forth in this Homeowner9s Service Policy & Homeowners
Warranty. Homeowner acknowledges receipt, review and acceptance of the terms of the said
Homeowner9s Service Policy & Homeowners Warranty. ALL OTHER EXPRESS OR IMPLIED
WARRANTIES ARE EXCLUDED, INCLUDING SPECIFICALLY ANY IMPLIED
WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE,
REASONABLE WORKMANSHIP, OR HABITABILITY. Homeowner understands and
Agrees that the written Homeowners Warranty provided by W.B. Homes, Inc. is in lieu of all
Other warranties and that W.B. Homes, Inc. makes no warranty, express or implied, as to
Quality, fitness for a particular purpose, merchantability, habitability, or otherwise.
THE MAXIMUM LIABILITY OF W.B. HOMES, INC. SHALL BE THE REPLACEMENT
COST OF THE DEFECTIVE PORTION OF THE HOME.
THIS WARRANTY IS NOT TRANSFERABLE TI A SUBSEQUENT OWNER OF THE
PROPERTY OR OTHERWISE.
W.B. HOMES, INC. SHALL UNDER NO CIRCUMSTANCES BE RESPONSIBLE
FOR ANY CONSEQUENTIAL DAMAGES. FOR EXAMPLE, IF A ROOF LEAK
(WHICH MAY BE COVERED UNDER THIS WARRANTY) CAUSES FURNITURE
IN THE HOUSE TO BE DAMAGED, W.B. HOMES, INC. SHALL NOT BE
RESPONSIBLE FOR ANY DAMAGES TO THAT FURNITURE OR ANY COST
TO REPAIR OR REPLACE THAT FURNITURE.
